Islam, Women and Human Right

The story shows that the man have significant role in spreading and Islamic development. None of the prophet is women meanwhile most of Ulama are man. At the same time, the Islamic doctrine, which is text majority couldn`t “talk”, but the interpreter “talk”. (Nashr Hamid Abu Zayd, 2000). For that reason, the Islamic doctrine couldn`t be separated with paradigms that develop it (Ulama).
The Man`s Domination
So, there is an estimation that the Islamic teaching “suspected” bring man`s interest. On the other word, the doctrine of Islam conveys the value, which is give more beneficial to the man and reduces the woman. The man gets the more chance rather than women. It is similar with religion developed in Western at middle era (in 6-15 century), even until renaissance`s era and the beginning of modern era (at 16-18 century). As stated by Karl Mark quoted by Franz Magniz Suseno (1999) that religion in Europe is a bourgeois` instrument to delude the proletarian. The hegemony of bourgeois and authority done by “nice cradle” of religion that finally would keep tyranny.


So, religion becomes “an ideology competition”, borrowing Ahmad Baso`s terminology (Ahmad Baso, 2003). The group who has authority would use the chance as an instrument to get the beneficial. It beneficial is not only in material but also the domination. The religion`s figure has the authority. In that competition the semiotic perversion was happened. The elite didn`t give the equal dialog, but perversion the verse based on the man`s desire. For that reason, the religion`s doctrine forced to serve the man`s interest. Meanwhile women forbidden to manage the public, even they`re voice and its movement barrier, and it is detriment the women.

In Islamic tradition, the middle patriarchal ideology dominates the Arabian`s life. For that reason, fiqh mahzab that they believed couldn`t be separated with patriarchal` values. It is not strange if in wedding discussion women place in weak position.

Human Right`s Breaking
Religion becomes an ideology competition, for that reason it is competed for holding the power. Later on the subject /religion`s elite formed (Ulama, clergyman, and etc) as a group that have role in making single interpretation, meanwhile the weak group couldn`t make interpretation. So there is no different between religion and colonialism. It is the human right`s breaking toward a women. The woman right has killed by man`s interpretation toward holy book. It is condition has dominated, for that reason “the weak group” didn`t feel that their right has been pulled.

The bad condition such happened before the coming of Islam occurred recently, whereas the Prophet Muhammad SAW uses the woman`s emancipation as one of the agenda. He got success to hold high the woman`s value from tyranny done by Arabian`s man. Discrimination is the refusal toward tauhid teaching. Tauhid is not only for God`s dimension but also in social. The logic consequence from tauhid is admitting the human`s equality. Discrimination toward women included in ignoring of human`s equality. We mayn`t obey the human right`s breaking. Based on Islamic perspective the tyrant and suppressed are repressed. For that reason the freedom is a must (CMM/Hilaly Basya/rd)
